PMMY Group Sdn Bhd ("Physiomobile") operates Physiomobile Elite corporate wellness programmes. Please read these Terms carefully. By submitting an inquiry form, signing a Service Agreement, or commencing any programme, the Client agrees to be bound by these Terms.
- Client / Company — The organisation or individual that engages Physiomobile Elite services, as identified in the Service Agreement or inquiry form.
- Service Agreement — The signed proposal, quotation, purchase order, or written confirmation governing the specific engagement.
- Programme — Any corporate wellness service including WRMSD Screening Days, Elite Subscriptions, Seminars, Workshops, Webinars, Treatment Booths, and Training Programmes.
- Therapist — A Physiomobile-registered physiotherapist or wellness professional assigned to deliver the Programme.
- Session — A single scheduled visit, consultation, treatment, or event delivery unit under the Programme.
- HRDC — Human Resources Development Corporation Malaysia (formerly PSMB).
- PDPA — Personal Data Protection Act 2010 (Malaysia).
Physiomobile Elite provides corporate physiotherapy and workplace wellness services as described in the applicable Service Agreement, including:
- WRMSD Screening Days — Musculoskeletal risk assessment for 20–200 employees per day at the Client's premises.
- Elite Subscription Plans — Regular scheduled sessions at the Client's premises on Essential (1×/week), Professional (2×/week), or Elite Daily (5×/week) tiers.
- Health Webinars — Online 60–90 minute educational sessions on back pain, ergonomics, and injury prevention.
- Corporate Seminars — On-site health awareness sessions for up to 200 participants.
- Ergonomics Workshops — Hands-on half-day practical sessions for 15–40 participants.
- Mini Treatment Booths — 10-minute per employee treatment sessions at corporate events.
- HRDC-Claimable Training — 1-Day and 2-Day certified workplace physiotherapy and MSK training programmes.
- A binding engagement commences upon the Client's written acceptance of Physiomobile's proposal or quotation.
- All programmes are subject to availability of Physiomobile therapists and resources in the Client's geographic area.
- Physiomobile targets programme commencement within 2–4 weeks of the signed Service Agreement, subject to scheduling and site readiness.
- The Client is responsible for providing a safe, accessible, and appropriate space for on-site sessions.
- Any changes to the agreed scope, frequency, or location must be agreed in writing by both parties.
- All fees are as set out in the Service Agreement or proposal issued by Physiomobile.
- Invoices are issued monthly in advance for subscription-based programmes, or per event for one-time programmes.
- Payment is due within 30 days of invoice date unless otherwise agreed in writing.
- Physiomobile reserves the right to charge late payment interest at 1.5% per month on overdue balances.
- All prices are in Malaysian Ringgit (RM) and exclusive of applicable taxes unless stated otherwise.
- For HRDC SBL-Khas claimable programmes, the Client is responsible for submitting and managing the grant claim directly with HRDC. Physiomobile will provide supporting documentation.
- Physiomobile reserves the right to revise fees with 30 days' written notice for subscription renewals.

- Physiomobile reserves the right to reschedule with 24 hours' notice due to therapist illness or emergency. An alternative therapist or date will be offered at no additional cost.
- For force majeure events (natural disasters, pandemic restrictions, government directives), sessions may be postponed without penalty to either party.
The Client agrees to:
- Provide a safe, clean, and adequately ventilated space of at least 3m × 3m for on-site sessions, with a treatment table or suitable surface available.
- Ensure participating employees have voluntarily consented to participate in the programme.
- Not record, photograph, or film Physiomobile therapists or sessions without prior written consent.
- Notify Physiomobile in advance of any health and safety requirements, site-specific rules, or access restrictions at the Client's premises.
- Ensure employees disclose pre-existing medical conditions, injuries, or medications to the therapist prior to treatment.
- Not request therapists to perform services outside the agreed scope, including emergency medical care.
- Provide timely access to premises, parking (where applicable), and any required visitor passes or security clearance.
- All Physiomobile therapists are registered with the Malaysian Physiotherapy Association (MPA) and operate under Malaysian Act 586 regulatory standards.
- All therapists carry professional indemnity insurance covering their activities during Physiomobile-organised sessions.
- Physiomobile is not liable for adverse outcomes arising from a participant's failure to disclose pre-existing medical conditions or contraindications prior to treatment.
- The Client is responsible for the safety of Physiomobile personnel while on the Client's premises.
- Physiomobile's maximum liability shall not exceed the total fees paid by the Client for the specific session or programme giving rise to the claim.
- Physiomobile is not liable for any indirect, consequential, or special damages including loss of revenue or reputational damage.
- All training materials, presentations, handouts, webinar recordings, health assessments, and programme content produced by Physiomobile are the intellectual property of PMMY Group Sdn Bhd.
- The Client may use materials provided solely for internal employee education. Materials may not be reproduced, distributed, sold, or shared externally without prior written consent.
- Physiomobile retains the right to use aggregated, anonymised programme data for internal research, marketing, and service improvement.
- The Physiomobile and Physiomobile Elite brand names, logos, and trademarks remain the exclusive property of PMMY Group Sdn Bhd.
- Both parties agree to keep confidential all proprietary business information, pricing, client data, employee health information, and programme details shared in connection with the engagement.
- Individual employee health data is strictly confidential. Physiomobile will not disclose individual health information to the Client organisation without the employee's express written consent.
- Physiomobile may share aggregated, anonymised health trend reports with the Client for programme evaluation purposes only.
- Confidentiality obligations survive the termination of the Service Agreement for 3 years.
Both parties agree to comply with the Personal Data Protection Act 2010 (PDPA) Malaysia in connection with all personal data processed under this engagement.
- Physiomobile will collect and process employee personal data solely for the purpose of delivering the agreed Programme.
- The Client shall ensure employees are informed that their personal data will be collected and processed by Physiomobile for programme delivery.
- Full data handling practices are described in the Physiomobile Privacy Policy.
- On termination, Physiomobile will retain employee data only for the minimum period required by law, after which it will be securely deleted.
- Subscription plans renew automatically on a monthly basis unless either party provides 30 days' written notice of non-renewal.
- Either party may terminate the Service Agreement for material breach with 14 days' written notice, provided the breach is not remedied within that period.
- Physiomobile may suspend or terminate services immediately if the Client's premises present an unacceptable health or safety risk to Physiomobile personnel.
- On termination, the Client shall pay all outstanding invoices for services already rendered. Physiomobile will refund prepaid amounts for sessions not yet delivered, less applicable cancellation fees.
- Sections covering Intellectual Property, Confidentiality, Data Protection, and Liability survive termination.
- Physiomobile's 1-Day and 2-Day certified training programmes are registered with HRDC and claimable under the SBL-Khas scheme, subject to HRDC approval.
- The Client is responsible for submitting the SBL-Khas application to HRDC prior to the training date. Physiomobile will provide required documentation including training outline, trainer credentials, and official receipts.
- HRDC approval is subject to HRDC's own eligibility criteria and is not guaranteed by Physiomobile. Physiomobile is not liable for HRDC rejection of a claim.
- Payment is due from the Client in full regardless of the outcome of the HRDC grant application.
- These Terms shall be governed by and construed in accordance with the laws of Malaysia.
- In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation within 30 days of written notice.
- If negotiation fails, disputes shall be referred to mediation under the Asian International Arbitration Centre (AIAC) Mediation Rules before proceeding to litigation.
- The courts of Malaysia shall have exclusive jurisdiction over any unresolved disputes.
- Entire Agreement: These Terms, together with the applicable Service Agreement, constitute the entire agreement between the parties and supersede all prior discussions or representations.
- Amendments: Physiomobile reserves the right to update these Terms with 30 days' written notice. Continued engagement after the effective date constitutes acceptance.
- Waiver: Failure by either party to enforce any provision shall not constitute a waiver of that provision.
- Severability: If any provision is held invalid or unenforceable, the remaining provisions continue in full force.
- Force Majeure: Neither party is liable for delays resulting from circumstances beyond their reasonable control, including acts of God, pandemics, or government directives.
- Notices: All formal notices shall be in writing and delivered by email to hq@physiomobile.com or the Client's registered contact email, with acknowledgement of receipt.

By engaging Physiomobile Elite services — whether through submitting an inquiry form, signing a Service Agreement, issuing a purchase order, or commencing a programme — the Client confirms that it has read, understood, and agrees to be bound by these Terms & Conditions.
